These percents can change without notice and it is your duty to check them daily.

We reserve the right to remove any site from our list, and adjust the amount of rakeback that we will offer back to our referred player. We also reserve the right to cease payments to our rakeback players and any of their referrals if the situation warrants, such as in case of one or more of the following events:

1. A poker site makes changes to its affiliate agreement whereby its affiliates, including rakebackfactory, are no longer allowed to advertise nor offer rake back to players.

2. A poker site amends the way that it handles affiliate payments, tracking of players' rake generation, and/or affiliate support.

3. A poker site adjusts the percentage of rake back that it gives to their affiliates, including us at rakebackfactory.

4. A change in the law pertaining to or regulation of poker sites or affiliates which impact our agreements with a poker site or with our referred players.

5. If a player is misrepresenting rakebackfactory's refer a friend program in a manner that is contrary to any of our poker sites player and affiliate terms and conditions.

6. A poker site reverses payments to us because of a chargeback or fraudulent activity.

7. If a player makes damaging comments in any public domain including forum, online chat, poker table chat and any other form of written communication about rakebackfactory

8. A poker site becomes insolvent and affiliate payments are delayed or terminated.

9. If as a direct result of a players actions monetary damage is caused to rakebackfactory in any form which results in loss of revenue to rakebackfactory on a particular site or network.

10. If a player has been banned from playing on and referring players to a poker site as a result of violating that poker sites terms and conditions.

11. If a player mentions publicly a private deal that they have been notified explicitly must remain offline or outside of the public domain, which further causes damages to rakebackfactory.

We will endeavour to notify our members as soon as possible if any such change is required and they will be informed on payment date or before if any change or cancellation of any rakeback or referral payments is required. A breach of any of the conditions above will may result in immediate termination of any account at the sole discretion of rakebackfactory.

When we report your rake generated stats we are simply relaying on the information provided to us by the poker site. We are not directly linked to our affiliated poker sites' reporting pages. They provided us with all of your statistics and we then report them to you. The figures you see reported to you via rakebackfactory are the actual amount owed to you as rakeback.

If one of our members feels that there are any discrepancies in the amount of rake they have generated, or amount of rake back that he or she has received from us, the member should notify us within 13 days from the close of the month. We will then be able to check the statistics and get back to you on the breakdown of your earnings. If you fail to contact us within 13 days your claim may be void but in all cases we will make a good-faith effort to resolve the issue.

If you fail to report your correct username/screename/account number when you are instructed to on that particular site sign up you may do so at anytime and we will make a good faith effort to make payment retroactively on your behalf up to and including the current month and up to three months prior. We are not liable for any payments that should have been made more than 90 days prior but will make payments for any future play.

Lastly, you are subject to the terms and conditions of all the poker sites on our list. The following information states the primary requirements for our members to receive rake back:

A. The player opens a new account on the site they wish to receive rake back.

B. The player does not have an existing real money account on this particular site.

If the player violates any of the rules outlined above, he or she will forgo any claim to receiving rake back or refer a friend income, as rakebackfactory may not receive any commission for his or her play. Also, in a rare case you do qualify by completing A and B, you may still not be properly linked to our affiliate account. In the event that you are not linked to us we will contact the site in question. We will request them to investigate why you are not linked to us. It is solely up to the poker site in question to add you to our affiliate account. In the event you are not added we are not liable to give you rakeback or any other type of compensation. You will only receive rakeback if you are attached to our affiliate account on the poker site in question. In the event of your account not being tracked to us we may contact the poker site on your behalf and will make our best efforts to have you properly tagged, however if this is not possible we are not responsible for paying rakeback to you. rakebackfactory or any other party involved with us, are not held liable for any reason if payments made by the poker site, or any other payment method are not delivered to you the player. You must also pay any fees associated with the transaction. All withdrawals are subject to the minimum withdrawal limits as stated on the withdrawal page. If you fail to meet this minimum amount required, you withdrawal will not be processed.

We also reserve the right to modify, change or terminate any information on this disclaimer/agreement at any time without warning. By signing up with one of our affiliated poker sites, or submitting any information to us via email or any other means, you are agreeing to these terms, and you will not hold rakebackfactory or any party involved with rakebackfactory liable for any damages.

THE COMPANY DOES NOT WARRANT THE FUNCTIONS CONTAINED IN RAKEBACKFACTORY THE SOFTWARE WILL MEET YOUR REQUIREMENTS, NOR THAT THEIR OPERATIONS WILL BE UNINTERRUPTED OR ERROR FREE. THE ENTIRE RISK AS TO THE USE QUALITY AND PERFORMANCE OF RAKEBACKFACTORY AND THE SOFTWARE LIES WITH YOU. THE COMPANY'S MAXIMUM LIABILITY TO YOU OR ANY THIRD PARTY ARISING OUT OF THIS AGREEMENT OR YOUR USE OF RAKEBACKFACTORY WHETHER FOR BREACH OF CONTRACT OR IN TORT, WILL BE LIMITED TO THE AMOUNT, IF ANY, YOU PAID TO ACCESS RAKEBACKFACTORY THE COMPANY WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH OR ARISING OUT OF THIS AGREEMENT OR YOUR USE OF RAKEBACKFACTORY THE GAMES, OR THE SOFTWARE, HOWEVER THEY ARISE, WHETHER FOR BREACH OF CONTRACT OR IN TORT, EVEN IF THE COMPANY RECEIVED PRIOR NOTICE OF THE POSSIBILITY OF SUCH DAMAGE. IN NO EVENT, SHALL COMPANY BE LIABLE FOR ANY MALFUNCTIONS OF THE SOFTWARE, BUGS OR VIRUSES, RESULTING IN LOST DATA OR ANY OTHER DAMAGE TO YOUR COMPUTER EQUIPMENT OR SOFTWARE.
